Terms of Service

1. Acceptance of Terms

By accessing or using TagCap ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

TagCap is a web-based platform for creating chat conversation videos. The Service allows users to design, customize, and render videos that simulate messaging app conversations.

3. User Accounts

• To use certain features, you must create an account using Google OAuth
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use

4. Token System & Payments

• 1 token = 1 minute of rendered video
• Shorter videos use proportional tokens (e.g., 30 sec = 0.5 tokens)
• New accounts receive 5 free tokens
• Additional tokens can be purchased
• Tokens do not expire while your account is active
• Refunds are not available for used tokens

5. Acceptable Use

• Do NOT create content that impersonates real people without consent
• Do NOT create fraudulent, deceptive, or misleading content
• Do NOT create content that is illegal, harmful, or violates others' rights
• Do NOT create content containing hate speech, harassment, or threats
• Do NOT create sexually explicit content involving minors
• Do NOT distribute malware or engage in phishing
• Do NOT attempt to gain unauthorized access to the Service
• Do NOT use automated tools to abuse the Service

6. Content Ownership

• Your Content: You retain ownership of all content you create using the Service
• License to Us: By uploading content, you grant us a limited license to process, store, and render your content solely for providing the Service
• Our Content: The Service, including its design, code, and features, remains our property

7. Watermarks

Videos rendered on free accounts include a TagCap watermark. Paid subscriptions allow watermark-free exports. Removing or obscuring watermarks from free videos is prohibited.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. Scheduled maintenance will be announced in advance when possible.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Termination

• We may terminate or suspend your account if you violate these Terms
• We may terminate if you engage in fraudulent or abusive behavior
• We may terminate if you fail to pay for purchased services
• You may delete your account at any time through your account settings

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be notified via email or prominent notice on the Service.

12. Age Requirements

You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent. We do not knowingly collect information from children under 13.

13. Intellectual Property

The Service allows creation of videos that simulate messaging app interfaces. Any trademarks, logos, or trade dress of third-party messaging platforms (such as Telegram, WhatsApp, iMessage) belong to their respective owners. TagCap is not affiliated with these platforms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Dispute Resolution

Any dispute arising from these Terms will first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue legal remedies in the appropriate courts.
